The Alliance For Free Citizens, a constitutionalist organization seeking passage of state-based legislation to protect American liberties, is raising a strong voice of protest to the Biden administration’s most recent violation of the U.S. Constitution and failure on the border crisis.
In March 2021, certain sectors of the southern border under the jurisdiction U.S. Customs and Border Patrol (CBP) were ordered to change the notices officers were issuing to illegal aliens.
8 U.S.C. § 1225(b) is clear in its requirement that CBP issue notices that initiate the process of removal and deportation out of U.S. sovereign soil. These Notices to Appear (NTA) were regularly understood as enforcement of federal law up until this year.
The Biden administration has instead instructed certain CBP officers and their jurisdictions to issue Notices to Report (NTR). Instead of commencing a removal process, it requests that an illegal alien voluntarily report to a specified station of U.S. Immigration and Customs Enforcement.
This information has been obtained through recent court filings by the Alliance, where we have been joined in agreement with the U.S. District Court for the Southern District of Texas, Galveston Division.
“Replacing an NTA with an NTR is wrong!” said Joshua Pratt, the Executive Director of the Alliance for Free Citizens. “This action by the Biden administration is the circumventing of law and the safeguards that are in place to protect the people of the United States from this type of criminal activity. The Biden administration, by issuing these orders, has usurped the will of US citizens to live safely by creating absolutely no accountability and no punishment for illegal entry into the US. In practice, this is the equivalent to throwing open the flood gates, exasperating the already spiraling border crisis and endangering Americans.”
